Legal Steps Are Being Taken To Save The House Of A Disabled Chicoan From Foreclosure

Legal steps are being taken to save the house of a disabled Chicoan woman from the clutches of foreclosure and eviction. Many lawyers filed cases against three firms charging them with predatory lending. The legal fraternity is hoping that this move will be of assistance to the woman. Evan O’Donnell of Legal Services of Northern California added, “She certainly deserves it after what she’s been through.”
53 year old Jan Poythress had only a few days at hand before being thrown out of her home in north east Chico in February 2009. The eviction has been stalled and Poythress continues to light her home fires while a new case is scheduled to be held that will challenge the legality of the move wanting her eviction.
The lawyers in a separate suit filed charges against Instant Mortgage Lending Corp. of San Diego, ForeclosureLink of Fair Oaks and Expedia Home Loan of San Diego wanting the cancellation of the loan and the foreclosure on the home of Poythress. In a phone interview O’Donnel quipped “When you read this complaint, you see how sinister this is,” O’Donnell said in a phone interview.”
In the suit it is stated that disabled Poythress resided in her house with her parents the major part of her adult days. The parents looked after her monetary affairs until they died. But after their demise Poythress became not only lonely but also vulnerable. Soon a smart talking sales man won her friendship and moved in with his girl friend. They did not pay any rent but rather coaxed her into buying them luxury goods like a car. After that the couple vanished.
Meanwhile Poythress had run up a huge credit card debt. This time another person contacted her saying he came from Expedia. He knocked on her twice or thrice a week until she agreed to take a mortgage loan to pay off her debts.
The house was expensive but Poythress had only a modest income from Social Security amounting to something below $1,000 per month. It was impossible for her to be current on her loan and she defaulted within a year of taking the loan.
According to the suit Instant Mortgage Lending started foreclosure proceedings against her in October 2008 and became the owner of the estate. Eviction orders were followed up.
But now a team of lawyers is up in arms against the lenders and digging up all their sins.
